Terms and Conditions

If you reside in the European Economic Area, the United Kingdom, or Switzerland, these Terms and Conditions apply between you and Cliqued.

1. Acceptance of the Terms and Conditions.

1.1 Consent to the Terms and Conditions

By creating a Cliqued account through a mobile device (“Service”), you agree to accept these Terms and Conditions, our Privacy Policy, Cookie Policy, Safety Tips, and Community Guidelines (“Agreement”). Additionally, you must agree to the terms disclosed for additional features, products, or services that we offer as part of the service. If you do not agree to these terms, we ask that you do not use the service.

1.2 Changes to the Agreement

We reserve the right to change the Agreement and the service from time to time. If the changes have a significant impact on your rights and obligations, we will notify you of these changes at least 30 days in advance, unless this is not legally permitted. If you continue to use the service after these changes come into effect, you agree to the revised agreement.

2. Eligibility.

It is prohibited to create an account on Cliqued or use the service or systems on which it is provided unless all of the following conditions are met:

You are at least 18 years old;
You are authorized to enter into a binding contract with Cliqued;
You will comply with this agreement as well as all applicable local, state, national, and international laws, rules, and regulations;
You have not committed any serious crimes, sexual offenses, or violent crimes in the past and are not registered as a sex offender in the state, federal, or local sex offender registry.

3. Your Account.

3.1 Sign up

You can sign up for the use of Cliqued in various ways, such as using your Email, Google, Apple or Facebook. For more information on the information we collect and how it’s used, please refer to our Privacy Policy.

3.2 Access Credentials

It is your responsibility to keep your access credentials for Cliqued confidential. You are fully responsible for any activities performed under these access credentials. If you suspect that someone has unauthorized access to your account, please notify us as soon as possible using our Contact Form.

4. Change of Service and Termination.

4.1 Change of Service

Cliqued aims to improve its service and provide its users with additional features that they find useful. To achieve this, it may be necessary to add new features or remove existing ones from time to time. These changes usually do not have a significant impact on your rights or obligations and can therefore be made without notice. In rare cases, it may also be necessary to temporarily or permanently suspend the service, in which case you will be informed in advance unless mitigating circumstances such as security concerns prevent this.

4.2 Termination of Your Account

You can terminate your account at any time by following the instructions in the settings of the service. However, if you use a third-party payment account such as the App Store, you must manage your in-app purchases through that account to avoid further billing. Cliqued may terminate your account at any time without notice if we believe you have violated this agreement. After such termination, you are not entitled to a refund. If your account is terminated, this agreement will be terminated.

5. Security and Your Interactions with Other Members.

Cliqued promotes a respectful user experience, but assumes no responsibility for the conduct of members within or outside of the service. It is strongly recommended to exercise caution, especially if you decide to communicate outside of the service or meet members in person. Before using the service, please read and follow the Safety Tips provided by Cliqued. Do not share any financial information, such as bank account details, with other members or send them money. Everyone is responsible for their own interactions with other members, and it is noted that Cliqued does not conduct a background check on its members. Cliqued makes no representations or warranties regarding the behavior or compatibility of its members.

6. Rights granted to you by Cliqued.

By using Cliqued’s service, you receive a free, personal license that is non-transferable, non-exclusive, revocable, and non-sublicensable. This license allows you to access and use the service, but you must use the service in accordance with the provisions of this agreement and the policies provided by Cliqued to enjoy all the benefits of the service. It is important to note that your license will automatically be revoked if you engage in any of the following actions:

Use the service in a way that could impair or disrupt the services, servers or networks, including uploading viruses or other malicious software that endangers the security of the service.
Accessing the navigation or display of the service or its content with automatic devices, methods, or processes that engage in “data mining” or otherwise replicate the content.
Commercial use of the service or the content contained therein without Cliqued’s written consent, or copying, modifying, or otherwise using intellectual property, copyrighted material, or information accessible through the service without Cliqued’s prior written consent.
Statements that give the impression of being endorsed by Cliqued or the use of references to Cliqued or the service in meta-tags, codes, or other devices to direct people to other websites.
Modifying, adapting, selling, reverse engineering, decrypting or decompiling parts of the service, or causing third parties to do so, or using or developing third-party applications that interact with the service or the content or information of other members without Cliqued’s written consent.
Investigating, querying or testing the vulnerability of the service, systems or networks, or promoting or supporting activities that violate the agreement.

Cliqued reserves the right to monitor and review all content that you post on the service. If Cliqued determines that the service is being used illegally or improperly, it may conduct investigations and take all available legal action, including terminating your account. The software provided by Cliqued may automatically download and install upgrades, updates, or new features, but you can adjust this through the settings on your device.

7. Rights granted to Cliqued by you.

7.1 Licensing of content

By creating a user account on Cliqued, you grant us a non-exclusive, transferable license to access, host, store, use, copy, display, reproduce, edit, publish, modify, and distribute all information provided by you. This information includes all content that you post on our service or transmit to other members, but only for the purpose of operating, developing, providing, and improving the service as well as researching and developing new services. You agree that all information provided by you after creating your account is truthful and accurate, and that you have the right to post content on our service and grant us the aforementioned license.

7.2 Monitoring of content

We reserve the right to monitor and review all content that you post on our service. We also reserve the right to delete content in whole or in part that we believe violates this Agreement or may harm the reputation of our service. If you provide us with feedback or suggestions regarding the service, you agree that we may use and share this feedback without compensation.

7.3 Confidentiality and access to account information

We are committed to treating your account information and content as confidential, but may access, store, and disclose your account information and content in certain cases where required by law or to fulfill our contract with you. We will do so only to, for example, comply with legal proceedings, respond to claims that content violates the rights of third parties, respond to customer service inquiries, or protect the rights, property, or personal safety of the company or another person.

7.4 Handling of customer service representatives

To ensure a respectful and friendly environment, you agree to treat our customer service representatives with respect and kindness. We reserve the right to terminate your account with immediate effect if we believe you are threatening, harassing, or offensive to our staff.

8. Community Rules.

Please read our Community Guidelines for a detailed overview of rules to follow when using our service. In short, you agree to abide by the following rules of conduct:

The service must not be used for illegal purposes or for purposes prohibited by this Agreement
The service must not be used for harmful or offensive purposes to harm Cliqued or to violate our community guidelines, which are updated from time to time.
Spamming is prohibited, as is cheating or requesting money from other members.
Impersonating another natural or legal person or posting pictures of another person without their permission is not allowed.
Bullying, stalking, intimidating, attacking, harassing, mistreating, or defaming others is prohibited.
Content that violates or infringes on a person’s rights, including publicity, privacy, copyright, trademark or other intellectual property rights or contract law, may not be posted.
Content that represents hate speech, is threatening, sexually explicit or pornographic, incites violence, or contains nudity or graphic or gratuitous violence is prohibited.
Content that promotes racism, fanaticism, hatred or physical harm of any kind against any group or individual is not allowed to be published.
Soliciting passwords or personal data from other members for commercial or unlawful purposes is prohibited, as is distributing personal data of other people without their consent.
Sharing an account with other members or creating multiple accounts is prohibited.
It is forbidden to create a new account if your account has already been terminated unless you have our permission.

Please note that we have the right to remove content that violates this Agreement or may harm the reputation of our service. Cliqued also reserves the right to review and/or terminate accounts without refunds for purchases made if there has been a violation of this agreement, the service has been abused, or a member has behaved in a manner that Cliqued deems inappropriate or illegal, including actions or communication that occur within or outside of the Service.

9. Content from other members.

Please note that Cliqued has the right to review and remove content that violates this agreement. However, it is solely the responsibility of the member posting the content to ensure that it complies with this agreement. Cliqued cannot guarantee that all content is in compliance with this agreement. If you notice any content on the service that violates this agreement, we encourage you to report it within the service or through our Contact form.

10. Purchases.

10.1 In-app purchases

When making an In-app purchase on the App Store, you will be asked to confirm the purchase. The purchase will be charged for the selected services at the displayed prices, including any value-added tax or similar taxes that may be levied on your payments. By making the purchase, you authorize Cliqued to charge the corresponding fee.

10.2 Automatic recurring subscriptions

If you wish to purchase an automatically recurring subscription via an In-app purchase, your payment method will continue to be charged for the subscription until you cancel it. After the initial commitment period, the subscription will automatically continue at the price you agreed to when signing up, unless you cancel it before the renewal date.

10.3 Cancellation of subscriptions and accounts

You can most easily cancel your account by following the instructions under “Settings” in the Service. Please note that objections to payments already made must be directed to the App Store. If you want to change or cancel your subscription, you can do so most easily by logging into your third-party account and following the instructions. Deactivating your account or deleting the app does not end or cancel your subscription, and Cliqued will retain all payments charged to your payment method until you end or cancel your subscription with the third-party account. If you are a resident of Germany, you can cancel your subscription with one month’s notice, and your right to terminate for cause remains unaffected.

10.4 Refunds

Cliqued generally retains all fees for purchases, and there are no refunds or credits for partially consumed periods, unless a refund is requested within 14 days of the purchase date or as provided by applicable law. As subscribers residing in the EU or European Economic Area, you are entitled to a full refund within 14 days of the start of the subscription without stating reasons in accordance with local laws. If you wish to request a refund, you must follow the instructions of the App Store.

11. Liability exclusions.

Cliqued provides the service “as is” and to the extent permitted by applicable law, without any warranty or guarantee of any kind, whether express, implied, statutory or otherwise, including all content contained therein. Cliqued does not warrant or guarantee that the service will be uninterrupted, secure, or error-free, or that content or information you obtain on or through the service will be correct. Cliqued is not responsible for any content that you, other members, or third parties post, send or receive through the service. Access to any material downloaded or obtained through the use of the service is at your own discretion and risk.

12. Limitation of Liability.

Cliqued, its affiliates, employees, licensors or service providers shall not be liable for indirect, consequential, exemplary, incidental, special, punitive or enhanced damages arising out of your use or access to the service. Cliqued is not liable for the conduct or content of other members or third parties in connection with the use of the service. Cliqued is not responsible for unauthorized access, use or alteration of your content, even if Cliqued has been advised of the possibility of such damages. Cliqued’s total liability to you in connection with all claims related to the service is limited to the amount you paid for the service while having an account, to the extent permitted by law.

13. Third-party services.

The service may contain advertisements and promotions offered by third parties, as well as links to other websites or internet resources. Cliqued is not responsible for the availability or non-availability of such external websites or internet resources. Your relationship with third parties you interact with through our service is subject to the terms of those third parties. Cliqued is not responsible or liable for the terms or actions of those third parties.

14. Entire Agreement.

This agreement, including the privacy policy, cookie policy, security notes, community guidelines, and all terms you have agreed to when purchasing additional features, products, or services that we offer through the service, represents the entire agreement between you and Cliqued regarding the use of the service. If any provision of this agreement is deemed invalid or unenforceable, the remainder of this agreement remains in full force and effect. The failure to exercise or enforce any right or provision of this agreement by the company does not constitute a waiver of that right or provision.

15. Miscellaneous.

You agree that your Cliqued account is not transferable and that your rights to your account and its contents terminate upon your death. This agreement does not establish an agency, partnership, joint venture, trust, or other special relationship or employment relationship, and you are not authorized to make representations or bind Cliqued in any way.
